Residence permit in Poland

 

Cases in which a foreigner can obtain a permanent residence permit, ie the so-called. Permanent residence card are as follows:

1) The permanent residence card is granted to a foreigner when he is a child of an alien who has been granted a permanent residence permit or a residence permit for a long-term resident of the EU under his Parental authority:

  • A permanent residence permit or a residence permit for a long-term resident of the EU, or
  • Period of validity of the temporary residence permit granted to that alien.

2) The Charter of Permanent residence for the foreigner is granted when he is a child of a Polish citizen under his parental authority.

3) The residence card is entitled to persons of Polish descent, who intends to settle in the territory of the Republic of Poland permanently.

4) The foreigner’s residence card is intended for an alien who is recognized by the Law of the Republic of Poland married to a Polish citizen for at least 3 years before the date on which he filed for permission to grant him Permanent residence, and immediately before submitting this application, remained uninterrupted in the territory of the Republic of Poland for a period of not less than 2 years on the basis of a temporary residence permit granted in connection with marriage to A Polish citizen or in connection with obtaining refugee status, subsidiary protection or residence permit for humanitarian reasons.

5) The residence card for the foreigner is entitled when he is a victim of trafficking within the meaning of art. 115 § 22 of the Criminal Code and:

  • Stayed in the territory of the Republic of Poland immediately before submitting the application for a period of not less than 1 year on the basis of a temporary residence permit for victims of trafficking,
  • Cooperate with law enforcement authorities in criminal proceedings for a crime referred to in art. 189A § 1 of the Criminal Code,
  • has reasonable concerns before returning to the country of origin, as confirmed by the prosecutor conducting the proceedings for the offence referred to in art. 189A § 1 of the Criminal Code.

6) The residence card of the foreigner is entitled to persons who immediately before submitting the application for a stay uninterrupted in the territory of the Republic of Poland for a period of not less than 5 years on the basis of refugee status, subsidiary protection or consent to stay for humanitarian reasons.

7) A permanent residence card is available to a foreigner who immediately before submitting the application stayed uninterrupted in the territory of the Republic of Poland for a period of not less than 10 years on the basis of consent for tolerated stay granted on Pursuant to art. 351 paragraph 1 or 3.

8) Residence card applies to persons who are granted in the territory of the Republic of Poland asylum.

9) The Residence card is intended for a person who holds a valid pole card and intends to settle in the territory of the Republic of Poland permanently.
