Obtain a permit for the acquisition of real estate, shares and stocks by foreigners.
Acquisition by a foreigner of the ownership right or the right of perpetual ownership of real estate and acquisition or subscription by a foreigner of shares or stocks in commercial companies based in the territory of Poland which are owners or perpetual owners of real estate located in Poland requires a permit from the minister of internal affairs.
However, there are few exceptions to this rule. The most common are if:
- foreigner is residing in the Republic of Poland for at least 5 years from granting him/her a permanent residence permit or a long-term resident’s European Union residence permit;
- foreigner is a spouse of a Polish citizen and resides in the Republic of Poland for at least 2 years from granting him/her a permanent residence permit
- acquisition by a legal person or a commercial company without legal personality having its registered office in Poland and controlled by foreigners, for statutory purposes, of undeveloped real estate, the total area of which in the whole country does not exceed 0.4 ha within the cities,
